Sanctions: Why Their Regulation Matters "The Case of Russia and Beyond"

With the recent discovery of a series of suspected war crimes in the Ukrainian town of Bucha and the fear of a new Eastern offensive, Western sanctions on Russia have reached a new high. Seen as the lesser of two evils against a Member of the United Nations Security Council and a nuclear power still supported by strategic allies, sanctions offer a seemingly efficient alternative to the use of military force. Yet, their damages on populations and their human rights have long been demonstrated. Not to mention that, in a globalised economy, their medium-term impact on the very countries issuing these sanctions is rather severe. Hence the need to regulate and monitor the use of this political tool for economic warfare at the crossroad between international law, trade, investment, or finance, and for which only a few legal scholars, other than human rights specialists, have shown interest. From a politico-legal and longitudinal perspective, this webinar will explore the legality of international sanctions to better understand what they are, and what they are not, as well as how they can legally backfire. In partnership with King’s College London and the Centre for Trade and Investment Law (New Delhi), Prof. Leïla Choukroune, Prof. Holger Herstermeyer, Prof. Takis Tridimas, and Prof. James Nedumpara had a conversation to bring interdisciplinary global perspectives.
